1. Introduction


1.1 These General Terms of Use (hereinafter referred to as the “Terms”) govern the use of the website www.cookandlive.com (hereinafter referred to as the “Website”) operated by
Cook and Live (hereinafter referred to as the “Company”).
1.2 The Company specializes in the sale and distribution of granola and related food products in compliance with EU food safety regulations (Regulation (EC) No 178/2002).
1.3 By accessing or purchasing products from the Website, you agree to these Terms. If you do not agree, please refrain from using the Website.
1.4 These Terms apply to consumers and business customers within the European Economic Area (EEA).

2. Products and Food Safety Compliance


2.1 The Company sells packaged food products that comply with EU food safety and labeling laws, including Regulation (EU) No 1169/2011 (Food Information to Consumers - FIC Regulation).
2.2 All ingredients, allergens, nutritional values, and expiry dates are clearly stated on product packaging and in product descriptions on the Website.
2.3 The Company ensures that food is stored, handled, and transported in accordance with HACCP principles (Hazard Analysis and Critical Control Points) and EU hygiene regulations (Regulation (EC) No 852/2004).
2.4 Product availability, descriptions, and prices are subject to change without prior notice.
2.5 While the Company strives for accuracy, product images and descriptions on the Website are for reference only and may differ slightly from the actual product.

3. Orders and Payment


3.1 By placing an order on the Website, you make an offer to purchase the selected products.
3.2 The Company reserves the right to reject or cancel orders in the following cases:


• The product is out of stock
• Incorrect pricing due to a system error
• Suspected fraudulent activity
• Non-compliance with legal requirements for food sales in your region

3.4 All prices include VAT where applicable. Shipping costs are displayed separately before checkout.

4. Shipping & Storage

• Products are packed securely to maintain quality and freshness.
4.2 Storage Conditions
• Products should be stored according to the instructions provided on the packaging.
• The Company is not responsible for product degradation due to improper storage by the customer.

5. Returns and Refund Policy


5.1 Right of Withdrawal (Return and Refund Request Deadline)


In accordance with EU Consumer Protection Law 2011/83/EU (Consumer Rights Directive),
consumers have the right to withdraw from their purchase within 14 days of receiving the product.
However, returns and refunds may be restricted in the following cases:
Eligible for Return
• The product is unopened and remains in its original packaging (including sealed packaging and labels).
• The product is undamaged and in resalable condition.
• The product has at least 30 days remaining before its expiration date.
Not Eligible for Return or Refund
• The product’s seal has been broken (for hygiene and safety reasons).
• The product has been damaged or deteriorated due to customer negligence or improper storage.
• The product has less than 30 days remaining before its expiration date (making resale impossible).
• Discounted or promotional items (items sold at a reduced price may not be eligible for return).
• Returned items that are not in a resalable condition.


5.2 Return Procedure


• Customers must submit a return request within 48 hours of receiving the product.
• Return requests must be submitted via [Customer Service Email] and must include the order number and reason for the return.
• Once the return is approved, the customer must ship the product to the designated return address within 10 days.
• Return shipping costs are borne by the customer, and a refund will only be processed if the product is received in its original condition.

 


5.3 Refund Policy


• Refunds will be processed within 7–14 days after the returned product has been inspected and approved.
• Refunds will be issued to the original payment method (credit card, PayPal, etc.).
• Shipping fees and other service charges from the initial purchase are non-refundable.
• If the returned product does not meet the eligibility conditions, the refund request will be denied, and the product may be reshipped to the customer at their own expense.

 


5.4 Defective or Incorrect Products


• If the product arrives damaged or differs from the order, customers must report the issue within 48 hours of receipt.
• In such cases, the company will arrange an exchange for the same product at no additional cost to the customer.
• If the product has been partially used, a partial refund or exchange may be considered after an inspection.
Important Notes
• If a product is returned without prior approval, the refund may not be processed.
• The company is not responsible for any damage that occurs during the return shipping process due to inadequate packaging.
• If a customer repeatedly requests returns due to change of mind, the company reserves the right to restrict future orders.

6. Consumer Responsibilities


6.1 Customers must ensure they provide accurate shipping details. The Company is not responsible for orders lost due to incorrect addresses.
6.2 Customers are responsible for checking allergen and ingredient information before consumption.
6.3 Customers must not misuse, resell, or distribute products without prior authorization.

7. Data Protection & Privacy


7.1 The Company processes personal data in compliance with the General Data Protection Regulation (GDPR, EU 2016/679).
7.2 Collected personal data includes:
• Name, address, contact details (for order processing)
• Payment details (processed securely via third-party payment providers)
• Order history

7.4 Customers have the right to:

• Request corrections or deletion of their data
• Withdraw consent for data processing

8. Liability and Limitations


8.1 The Company ensures food safety compliance but is not liable for:

• Improper storage after delivery
• Delays caused by external shipping carriers
8.2 Nothing in these Terms limits the statutory consumer rights provided under EU consumer protection laws.
